Pick N Drop provides a technology platform connecting Users and independent third-party service providers (“Service Providers”). 
Service Providers are independent contractors, not employees or agents of Pick N Drop. 

3. User Accounts

  • Maintain accurate information and confidentiality. 
  • You are responsible for all activity on your account. 
  • We may suspend or close accounts violating policy. 

4. User Conduct

Do not use the Platform to break laws, harass others, disrupt systems, or damage property. 
Respect drivers, riders, and staff. 

5. Payments and Fees

Charges appear before confirmation and may vary by demand, distance, or fees. 
Pick N Drop acts as limited payment collection agent for Service Providers. 
All charges are final and non-refundable unless required by law. 
Tips are voluntary and go directly to the provider. 

6. Arbitration Agreement

All disputes are resolved by binding individual arbitration under the Federal Arbitration Act and California law. 

  • No jury trial or class actions. 
  • Administered by ADR Services Inc. or a comparable forum. 
  • You may opt out within 30 days of accepting these Terms by emailing info@pickndropapp.com. 
  • Certain claims (e.g., small-claims or IP matters) may go directly to court. 

7. Termination

We may suspend or terminate accounts for misconduct or legal reasons. 
You may close your account anytime by contacting info@pickndropapp.com. 

8. Disclaimers

The Platform and services are provided “as is” and “as available.” 
We make no express or implied warranties. 
We are not responsible for the actions or omissions of independent Service Providers. 

9. Limitation of Liability

To the fullest extent permitted by law, Pick N Drop is not liable for indirect, incidental, or consequential damages, lost profits, or personal injury arising from use of the Platform or third-party services. 

10. Indemnification

You agree to indemnify and hold harmless Pick N Drop LLC, its affiliates, officers, and employees from claims, damages, or expenses caused by your use of the Platform or violation of these Policies. 

11. Governing Law and Venue

These Policies are governed by California law, with exclusive jurisdiction in the state or federal courts of San Francisco County, California, for matters not subject to arbitration.

We may send notices by email, in-app alerts, or postings on the Platform.

13. General Provisions

  • No joint venture or employment relationship is created.

    5.1 Passenger Responsibilities  

    Passengers agree to:

    • Provide accurate pickup and drop-off details.
    • Treat drivers respectfully and follow all lawful instructions related to safety.
    • Wear seat belts at all times.
    • Pay all applicable fares, tolls, cancellation fees, and surcharges.
    • Avoid bringing illegal goods, open alcohol, hazardous materials, or weapons.

    5.2 Safety & Conduct 

    Passengers must not:

    • Harass, threaten, or harm drivers.
    • Damage the driver’s vehicle or property.
    • Request or pressure drivers to violate traffic laws or exceed legal speed limits.

    Pick N Drop LLC may suspend accounts for unsafe behavior or policy violations.

    5.3 Pets, Service Animals, and Cleanliness  

    • Service animals are permitted as required by applicable laws.
    • Non-service pets are allowed only with driver consent.
    • Passengers are responsible for keeping pets secured and preventing damage.
    • Cleaning fees may apply for spills, excessive dirt, pet accidents, or damage.

    5.4 Cancellations and No-Show  

    Passenger cancellations may incur a fee if:

    • A driver has already accepted the ride.
    • The driver has reached the pickup location.
    • The passenger fails to show within the wait time window.

    5.5 Personal Items  

    Pick N Drop LLC is not responsible for items lost or left behind.

    6. Driver Terms 

    6.1 Driver Eligibility  

    Drivers must comply with all regional laws and requirements, including:

    • Valid driver’s license for the region of operation.
    • Proof of vehicle insurance and registration.
    • A vehicle that meets local safety and quality standards.
    • Background checks, document verification, and identity validation.
    • Meeting local age and driving-history requirements.

    Pick N Drop LLC may periodically request updated documents.

    6.2 Independent Contractor Status  

    Drivers acknowledge that:

    • They are independent contractors, not employees of Pick N Drop LLC.
    • They choose when and where to drive.
    • They are solely responsible for taxes, expenses, fuel, insurance, and maintenance.

    6.3 Driver Responsibilities  

    Drivers agree to:

    • Provide safe, lawful, and professional transportation.
    • Follow traffic rules and all applicable ride-share regulations.
    • Maintain a clean, damage-free, and roadworthy vehicle.
    • Treat passengers respectfully and avoid discrimination or harassment.
    • Maintain active insurance coverage required by local laws.

    6.4 Zero-Tolerance Policy  

    Drivers may not operate a vehicle:

    • Under the influence of alcohol, drugs, or impairing substances.
    • While fatigued, distracted, or unfit to drive.

    Reports of impairment may result in immediate deactivation pending investigation.

    6.5 Pets & Service Animals  

    • Drivers must accept service animals as required by law.
    • Drivers may decline non-service pets at their discretion.
    • Drivers must notify Pick N Drop LLC of any pet-related incidents requiring cleaning.

    6.6 Trip Acceptance  

    Drivers are free to accept or decline trip requests unless restricted by local laws.
    Excessive cancellations or unprofessional behavior may affect driver status.

    6.7 Earnings & Payments  

    Driver earnings are calculated based on:

    • Time and distance
    • Base fares
    • Surge/multiplier pricing
    • Tolls and safety fees (where applicable)
    • Platform service fees

    Payments are made through Pick N Drop’s payment system.
    Drivers must maintain valid payout account details.
